C. Redemption.

Participation in the Offer/attempting to obtain Offer in a manner other than in accordance with these Terms may constitute fraud. This includes but is not limited to any misrepresentation as to identity and/or completion of the purchase of a HairClub Solution. In addition to withholding of the Offer, Sponsor may take any other necessary and appropriate actions, so as to protect their respective legal rights.

Offer is not redeemable or exchangeable for cash (except where required by applicable law).

Offer rights are not assignable/transferable; only the consumer who completed an order on shop.hairclub.com is eligible to receive the Offer.

D. Limitations of Liability

Sponsor assumes no responsibility for any computer, telephone, cable, network, electronic, programming or Internet hardware or software malfunctions, failures or errors of any kind including: emails (including attachments) that are inaccessible, undeliverable, corrupted, garbled, jumbled, late, lost, misdirected, incomplete, delayed for any reason. If circumstances beyond the control of Sponsor (i.e., a force majeure event, such as a strike, civil unrest, natural cataclysm, equipment failure/malfunction/error or tampering/unauthorized intervention) interferes with or prevents altogether Sponsor's implementation of the Offer as originally intended (as determined by Sponsor in its sole discretion), Sponsor may in its sole discretion, modify, suspend or terminate the Offer and honor only those valid requests (if any) received prior to such action by Sponsor; and, in such event, notice of such action will be posted at www.hairclub.com.

By participating in Offer, consumer releases, discharges, indemnifies and holds harmless Sponsor, and (as appropriate), its respective parent companies, affiliates, subsidiaries, franchisees, distributors, individual retail licensees, divisions, and agencies, as well as their respective officers, partners, principals, directors, affiliates, employees and agents of each of the foregoing, from and against any claims, damages or liability due to any injuries, damages or losses to any person or property of any kind resulting in whole or in part, directly or indirectly, from the Offer.
